All products, services, content, and readings offered by Flickering Fortunes are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied. Nothing on this site is intended to be — and should never be relied upon as — professional medical, mental-health, psychiatric, psychological, legal, financial, tax, investment, business, relationship, or emergency advice.

Always consult a qualified licensed professional (doctor, therapist, attorney, financial advisor, etc.) for any decision that may affect your health, finances, safety, legal standing, or well-being. If you are experiencing a medical or mental-health emergency, call 911 (or your local emergency number) or go to the nearest emergency room immediately.

Tarot readings, oracle readings, intuitive guidance, affirmations, candle "fortunes," and any other spiritual, metaphysical, or divinatory services offered by Flickering Fortunes or Mystic Mandi are provided for entertainment, personal reflection, and spiritual exploration only. They are not, and must never be treated as, a substitute for:

• medical advice, diagnosis, prognosis, treatment, or prescriptions from a licensed physician, nurse, psychiatrist, psychologist, therapist, or other healthcare professional;
• mental-health counseling, crisis intervention, or suicide-prevention services;
• legal counsel, court advice, or representation from a licensed attorney;
• financial, tax, investment, accounting, insurance, or business advice from a licensed professional;
• any other professional, regulated, or licensed service.

You agree that you will never use a reading in place of, or to delay, professional care or advice. Any action you take (or do not take) based on a reading is your sole decision and your sole responsibility. Results, interpretations, and outcomes are subjective, are not guaranteed, and may vary widely from person to person.

Readings are offered only to persons 18 years of age or older. By booking a reading you confirm that you meet this age requirement.

Our candles are hand-poured, individually made, and contain an open flame. Many of our candles are decorative, sculptural, or novelty pieces and are not necessarily intended to be burned in full, unattended, or at all. Please read the Candle Care page in full before lighting any candle.

By purchasing, accepting, lighting, or otherwise using any candle from Flickering Fortunes, you acknowledge and assume all risks associated with open flames, hot wax, melted wax pools, smoke, soot, and combustion. This includes (without limitation) the risk of fire, burns, property damage, injury, smoke inhalation, allergic reaction, and death.

You agree to: never leave a burning candle unattended; keep candles out of reach of children, pets, and flammable materials; burn only on a heat-resistant, level, stable surface; stop burning when 1/2 inch of wax remains; and follow all instructions and warning labels. Flickering Fortunes is not responsible for any damage, injury, or loss caused by improper use, modification, or burning of our candles.

Candles may contain fragrance oils, essential oils, dyes, mica, glitter, embeds, wood wicks, and other materials that may cause allergic reactions, skin irritation, or respiratory sensitivity in some individuals. If you have allergies, sensitivities, asthma, or are pregnant, please contact us before purchasing and consult your physician. Discontinue use immediately if you experience any reaction.

Because items are handmade, each candle is one of a kind. Colors, scent strength, shape, finish, embeds, and dimensions may vary from photos shown. Slight imperfections are part of the craft and are not defects.

Ready-made candles ship within 2–3 business days. Custom and made-to-order candles take 5–7 business days to pour, cure, and pack before they ship. Tarot readings are delivered on the timeframe stated on each reading's page.

We ship within the United States. Local pickup may be available — choose it at checkout if you see the option. International shipping is available on request; email flickeringfortunes@yahoo.com before ordering.

Once a package is handed to the carrier, delivery times, lost packages, customs delays, weather delays, and porch theft are outside our control. Title and risk of loss pass to you upon delivery to the carrier.

Because each candle is hand-poured and many are custom or made-to-order, all sales are final and we do not accept returns or exchanges. If an item arrives broken or damaged in transit, email us within 7 days of delivery with photos of the item and packaging and we will, at our sole discretion, offer a replacement, store credit, or refund. Tarot readings and custom orders are non-refundable once work has begun.

We collect only what we need to process your order or reading and to communicate with you: your name, email, shipping address, order details, any notes or questions you submit, and basic analytics about how the site is used. Payment information is handled directly by our payment processor — we never see or store your full card number.

We use the information you give us to fulfill orders, send order updates, respond to inquiries, and (if you opt in) send occasional newsletters or promotions. We do not sell or rent your personal information. We may share information with service providers strictly as needed to operate the business (payment processing, shipping, email delivery, hosting).

Emails captured anywhere on this site (newsletter, checkout, contact form, custom-order request) may be saved to our internal contact list so we can follow up about your order and, where permitted, send occasional promotional emails about Flickering Fortunes. You may unsubscribe from marketing emails at any time using the unsubscribe link or by emailing us. Transactional emails (order confirmations, shipping updates) will still be sent.

You may request a copy or deletion of your personal information at any time by emailing flickeringfortunes@yahoo.com. We honor applicable privacy rights under U.S. state and federal law.

By accessing this website, placing an order, booking a reading, submitting a form, subscribing to the newsletter, or otherwise interacting with Flickering Fortunes, you agree to these Terms in full. If you do not agree, do not use the site or our services.

You confirm that you are at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) and have the legal capacity to enter into this agreement. You agree to provide accurate information, to use the site only for lawful purposes, and not to misuse, copy, scrape, resell, or interfere with the site or its content.

Prices, availability, descriptions, photos, scents, colors, and product details may change at any time without notice. We reserve the right to refuse, cancel, or limit any order at our sole discretion (with a refund of any amount actually paid). Promotions and discount codes may be modified or revoked at any time.

We may update these Terms at any time. Continued use of the site after changes are posted means you accept the updated Terms.

To the fullest extent permitted by applicable law, Flickering Fortunes, Mystic Mandi, and our owners, employees, contractors, partners, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including (without limitation) loss of profits, revenue, data, goodwill, business, opportunity, savings, use, health, relationships, or emotional distress, arising out of or relating to your use of the site, our products, our readings, our content, or these Terms — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any and all claims arising out of or relating to the site, our products, our readings, or these Terms shall not exceed the greater of (a) the amount you actually paid to Flickering Fortunes in the six (6) months immediately preceding the claim, or (b) one hundred U.S. dollars ($100).

You acknowledge that this limitation is an essential part of the bargain and that we would not provide the site or our products at the prices charged without it. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless Flickering Fortunes, Mystic Mandi, and their respective owners, employees, contractors, partners, suppliers, and affiliates from and against any and all claims, demands, losses, liabilities, damages, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the site, our products, or our services; (b) your violation of these Terms; (c) your violation of any law or any right of a third party; (d) any content you submit; or (e) any injury, damage, or loss caused by your use, handling, lighting, or storage of any candle or other product purchased from us.

All content on this site — including text, photos, illustrations, logos, branding, product designs, candle shapes and silhouettes, reading scripts, names, and the "Flickering Fortunes" and "Mystic Mandi" marks — is owned by us or licensed to us and is protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, distribute, resell, republish, or create derivative works without our prior written permission. Personal, non-commercial sharing on social media with credit is welcome.

These Terms and any dispute between you and Flickering Fortunes are governed by the laws of the State of New York, United States of America, without regard to its conflict-of-laws principles. Exclusive venue for any claim that proceeds in court (including small-claims actions) shall be the state or federal courts located in New York.

You and Flickering Fortunes agree that any dispute, claim, or controversy arising out of or relating to these Terms, the site, our products, our readings, or our communications will be resolved exclusively through final and binding individual arbitration, not in court, except that either party may bring an individual claim in small-claims court if it qualifies. You and Flickering Fortunes waive any right to a jury trial and any right to participate in a class action, collective action, or representative proceeding. Any claim must be brought within one (1) year after the claim arises or it is permanently waived.

If any portion of this section is found unenforceable, the remainder of these Terms remains in effect. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and proceed in court.
